Political Uncertainty on Capitol Hill: Preparing for a Potential Government Shutdown

With mounting political uncertainty on Capitol Hill, the possibility of a government shutdown beginning October 1, 2025, is becoming increasingly likely. Such an event could disrupt critical immigration processes and create uncertainty for employers and foreign national employees alike.

  • A shutdown would impact the processing of key immigration applications, including Labor Condition Applications (LCAs) and H-1B filings. Delays and backlogs could affect business continuity, workforce planning, and compliance timelines.

Recommendations for Clients

  • To mitigate risks and ensure preparedness, we strongly recommend the following proactive steps:
    • IMMEDIATELY submit LCAs for all extension cases projected to be filed in the next two to three months.
    • File multi-slot headquarters-based LCAs covering multiple positions or categories of positions for which H-1B applications are routinely filed. These LCAs may only be used in emergency or exigent circumstances but having them pre-certified can provide critical flexibility if the shutdown disrupts normal processing.

By taking these steps now, employers can safeguard against unexpected delays and maintain compliance even if government functions slow down or halt temporarily.
