New U.S. Immigration Fees Take Effect

Here’s a breakdown of the changes and what they mean for applicants going forward:

1. Asylum Application Fee – ₹8,300 (Approx. $100)

• New Rule: Form I-589 now requires a $100 fee
• Annual Requirement: Applicants must also pay a $100 yearly fee while their case is pending
• USCIS will notify applicants about annual payment deadlines

2. Work Permit (EAD) Fees – Up to ₹45,800 (Approx. $550)

Using Form I-765:

• $550 for first-time applicants
• $275 for renewals
• $275 if linked to parole (Form I-131). The EAD allows immigrants to legally work while awaiting decisions on their immigration status

3. TPS Registration – ₹41,700 (Approx. $500)

• TPS applicants using Form I-821 must now pay $500 (up from $50)
• TPS offers temporary residence and work authorization for nationals of countries affected by crises

4. Special Immigrant Juvenile Fee – ₹20,800 (Approx. $250)

• Children applying under Form I-360 for SIJ status must now pay a $250 fee
• These are minors seeking protection due to abuse, abandonment, or neglect
  

Don’t Miss Deadlines

Applicants with asylum cases filed after October 1, 2024, will be personally notified by USCIS when their Annual Asylum Fee (AAF) is due.

Payment is required each year on the anniversary of the application until the case is resolved.

Work Permit Validity Also Changing

• Parolees: EADs valid for 1 year or until parole ends, whichever comes first
• TPS Holders: EADs valid for 1 year or until TPS status expires

Additional Fees

• These are new fees under H.R. 1 and do not replace existing USCIS filing fees
• If eligible, you may still request a fee waiver using Form I-912, for existing USCIS charges only. The new H.R. 1 fees cannot be waived under any circumstances
  

USCIS will soon announce additional increases for:

• Form I-131 (travel permits/advance parole)
• Form I-102 (replacement of I-94 travel records)
